Trial Of RUSH Guitarist's Son A Familiar Tune

For a case that isn't supposed to be about music, the trial of Justin Zivojinovich this week has had its share of musical moments.
And not just classic rock, the bailiwick of the defendant's father, RUSH guitarist Alex Zivojinovich.
There were snippets of country and western, easy listening, rap and classical.
The very nature of the case against the younger Zivojinovich, accused of fighting with sheriff's deputies as he was being led from The Ritz-Carlton, Naples, during a boisterous New Year's Eve celebration, follows a musical maxim — "I say to-may-to, you say to-mah-to."
The conflicting interpretations of what happened at the Ritz caused Judge Charles T. Carlton to reduce the charge against Zivojinovich to a misdemeanor. Carlton put a halt to Wednesday's proceedings and attorneys huddled, presumably to consider the possibility of a plea agreement, a courtroom version of "Let's Call the Whole Thing Off".
But even before the trial reached that crescendo, music had been established as a theme.
Potential jurors were questioned as to their musical tastes. The owners of easy listening FM 101.1 will be happy to know they have a loyal following in the Collier County juror pool.
And who knows, with previous titles such as "Permanent Waves" and "Red Barchetta," perhaps RUSH will choose as the name of its next album "White Noise", after the static-producing device Carlton employed to keep jurors from hearing his private discussions with attorneys at the bench.
